Agreement to these terms

Welcome to Vrabode, a brand of Vacation Rental MV, LLC. By accessing or using vrabode.com, you agree to these Terms and Conditions. If you do not agree, please do not use the site. We may update these terms from time to time, and your continued use of the site means you accept the current version.

About Vrabode

Vrabode markets and facilitates direct bookings of privately owned vacation rental homes on Martha’s Vineyard. Property listings, availability, rates, and descriptions are provided through our booking system and the property owners, and may change without notice. We work to keep this information accurate but do not guarantee that every detail is complete or error free.

Bookings and the rental agreement

Reservations are made through our third-party booking provider. Each property is offered subject to its own booking agreement, house rules, occupancy limits, cancellation policy, deposits, taxes, and fees, which are presented to you during booking. Those property-specific terms govern your stay and control if they differ from these general terms. A reservation is confirmed only when you receive a booking confirmation through the booking system.

Pricing, availability, and errors

Rates and availability are subject to change until a booking is confirmed. In the event of an obvious pricing or description error, we reserve the right to correct the error and to decline or cancel any booking affected by it, even after a confirmation has been sent. Where required, applicable state and local taxes and short-term rental fees are added to the reservation total.

Payments, deposits, and fees

Payments, security deposits, cleaning fees, and any additional charges are processed and held through our booking provider under the terms shown for each property. Refundable security deposits, where required, are handled according to the property’s booking agreement.

Cancellations and refunds

Cancellations and refunds are governed by the cancellation policy shown for each property at the time of booking and in that property’s rental agreement. Please review the cancellation policy carefully before you reserve.

Guest responsibilities

When you book a stay, you agree to:

• Provide accurate guest information and not exceed the stated maximum occupancy.
• Use the property as a private residence only, with no parties or events unless the property expressly permits them and written permission is obtained.
• Bring pets only where the property allows them and only with any required pet fees and documentation.
• Comply with all house rules, community and neighborhood rules, and Massachusetts and local short-term rental regulations.
• Treat the property and its furnishings with care, and accept responsibility for any loss or damage caused during your stay beyond normal wear.

Short-term rental registration and local compliance

Properties are offered in accordance with applicable Massachusetts and town short-term rental registration requirements. Guests agree to abide by occupancy limits, noise and parking rules, and other local ordinances that apply to the property.

Assumption of risk and limitation of liability

You use each property, its amenities, and any island activities at your own risk. To the fullest extent permitted by law, Vrabode and Vacation Rental MV, LLC, and the property owners, are not liable for any indirect, incidental, or consequential damages arising from your use of the site, a booking, or a stay. To the fullest extent permitted by law, our total liability for any claim is limited to the amount you paid for the affected booking.

Indemnification

You agree to indemnify and hold harmless Vrabode, Vacation Rental MV, LLC, and the property owners from any claims, damages, or expenses arising from your breach of these terms, your violation of any law, or your use of a property.

Intellectual property

The content on this site, including text, photographs, layout, and the Vrabode name and marks, is owned by or licensed to Vrabode and may not be copied, reproduced, or reused without our written permission.

Third-party links and services

The site relies on and links to third-party services, including our booking provider and mapping services. We are not responsible for the content, policies, or practices of those third parties. Your use of their services is subject to their own terms and privacy policies.

Changes to these terms

We may revise these Terms and Conditions at any time. The “Last updated” date at the top of this page reflects the most recent version. Continued use of the site after changes are posted constitutes acceptance of the revised terms.

Governing law

These terms are governed by the laws of the Commonwealth of Massachusetts, without regard to its conflict of laws rules. Any dispute arising from these terms or your use of the site will be handled in the state or federal courts located in Massachusetts.
